US authorities insist Luis Posada Carriles would remain in American custody although he has been ordered expelled. He is wanted in Venezuela for the 1976 bombing of a Cuban airliner that left 73 people dead.
The United States refuses to send Posada Carriles to Cuba or Venezuela, citing fears that he would be tortured. He is a radical opponent of Cuban leader Fidel Castro and a former CIA agent.
However the U.S. has also failed to find another third country that would accept Posada Carriles aged 78.
Cuban and Venezuelan authorities accuse the US government of harbouring a known terrorist. Posada Carriles fled the Venezuelan prison in 1985.
In mid-April last year, he officially requested political asylum in the United States.
