We adopted my wife neice in the Philippines. The adoption was complete in Dec./2004. We were in the Philippines for her visa July 30/2007. We were told that everything was ok. In Nov.05,2007 We receive notice that her visa was denied. All of her paper work has been sent back to U.S.C.I.S in Calif. to this day we still don,t know what to do. Our daughter was four years old when we sarted adoption. She is now Twelve. Immigraitions is a big headache. Now what. Also we have sent a letter to Dr. Phil, Opra, Presdent Obama

Thank you for your question Jean:

The application was probably denied because you did not satisfy the two year residency requirement. If you adopt a child The child must reside with you for at least two years before you submit the paperwork to immigration otherwise they will not approve the case. The only thing I would suggest is to try doing a student visa for her which is a temporary visa and then try the petition once shes here.

You should wait until your husband becomes a US Citizen to submit your paperwork. There is no visa available to you if he files as a permanent resident. As a US Citizen the green card would be approved within six months.

I am a soccer coach and just came upon a growing problem of high school students who were brought here by the parents on a visitors visa and remained illegally. Now that these students are ready for college they cannot receive scholarships because they're here illegally. Permanent Green I-90
I was married to my husband in 1971 , devorced and married to him again in 2005.
I got my green temporary green which expired in July 2009. I am not yet living in the states but I have been making regular visits. I am hoping to join my husband soon. Would I need to be living in the states to get my permanent green card which I need to apply 90 days before the expiration date. I had to stay behind because my adopted daughter application was not completed until October of this year which they had given her up to six months to submit. One of the reasons for not going over now is because I cannot sell my property.

Father & Mother US Citizen, am married in the Philippines
I am over 21 y/o, father & mother in the US and both US citizen?
I want to know how I can get them to petition me. I am now married 28 years of age. Father and mother have different families of their own. When I was conceived, my mother was in the US with me in her womb. She then gave birth in the Philippines then she went back to US and I got stuck in the Philippines. 2006 the first time I saw my father and his kids to visit me. A sad story indeed.

My question is, is there any law of abandonement I can file in the US embassy?or anything at all I can do? By the way, on my birth certificate the only name listed is my mom(in the US) my father listed as N/A. Although, DNA will prove otherwise that he is my father. Now I am in Saudi Arabia earning money so I can support my wife and earning some money so I can go to the US as a tourist maybe then my father or my mother can help me with my situation and petition me. Is there anyone that can tell me what to do for me to get petitioned by either one of them? Can I file for abandonement? if yes, whats the first step I should do?I would be willing to have my own attorney and pay.thank you everyone in advance!

what i need to know is that im on two probations in the city of mcdoungh and in herny county and i just got a ticket a week ago and today i got a paper in the mail saying that my court date has been moved because of me being on probation with the judge i was going to see but what i want to know is will my probations find out before i go to court and put out a warrent for me for v.o.p.?i report on the second week of ocbter.i really really need this info.i want to know this because of what that paper said becayuse i dont know if they would call my probation and send them something becasue of the judge thing.i want to know will they know or put a warrent out for me before the 7th of ocbter?please help me.

Deportee returning to the us

Hello,
I am a U.S.C. and I have a daughter by a Jamacian Citizen who was deported last year. We have been together for 7 years prior to his deportation.
He went through 2 drug proceedings, prior to the deportation hearing, and both drug charges were dismissed; however, he was convicted of Moral Perpetuted, telling a gov. agent he was a u.s. citizen, and orderd to be removed from the U.S. I am not sure if the judge said he could not return for 10yrs. or if he could not change his status for 10yrs. If the case is that he cannot change his status for 10yrs. do you think he will be allowed a visitors visa? Also, if we decide to get married can we apply for a finace' visa, or if we get married in Jamaica, do you think he will be allowed to come to the states.

Shoplifting and I-485
Hello, I have my temporary residence and I have to apply now for the permanent before april 2009. My husband is american and my baby was born during our marrige. A month ago I did a big mistake, I did shoplifting and they took me to jail for shoplifting under $300, which is a misdemeanor. My court is on August 15. I hired a lawyer and he stated there is a probability it get dismiss.
Now my concern are about my inmigration status; first, I have a family trip (husban,daughter and I) on Octuber and I was reading that inmigration officers at the entrance of USA have the authority to deport you if they see that you have a criminal record, I do not know if I would be save or nothing would happend to me when I am coming back home, Is that possible? What would you recommend me?
Second, I have to apply for my permanent residence, what are my options, What would you suggest my lawyer should ask on court? If my case is dismiss I wont have inmigration problem?

I really need an advise, I do not want to make any mistakes I have my baby and I can not risk loose her

Misdemenor and visitor visa
I was charged with misdemeanor class B, which was later reduced to class c for which I paid fine of 500$ and 30 hrs community service and the case was disposed. I am now applying for visitor/ tourist visa. I would like to know will I get the visa or they can deny me entry on the charge bases. I have not got it expunged yet.

My husband was planing to come to US on H1 will I be allowed H2 if I apply for it later.
We have Australian citizenship.

from my husband he is very controling and demaning i canot have any friends of any kind i couldnot speak to my mom on the phone and he mentaly aboused to me and told me he is trying to put me in a mental hospital he also said he will kill me for leaving him i want to get devoice bet he dont want to give ti to me what do i do at this point i call the police but he just resort to otther ways to create problems for me like calling child protiction service on me but it did not work out the wayhe want so he trying other thing like spiing on me and reading my messages and so on what do i do how can i get a devoice from him

hi 15 years ago my friend was in jail for 3 months for domestic violence and small amount of drugs,then he was deported to his country london for overstaying with his visa here in usa.he wants to apply again for a work visa cos he is a musician and have many offers to have a tour here in usa.he has a very susscessful career.is there any way he can apply again to enter here in to US?

an annullment/divorce
Hi, I recently got married to a jamaican. He is verbally, sexually and mentally abusive. I get about 2 hours sleep some nights. Have been unable to function on my job and I am afraid of him. He has threaten to kill me or have someone do it if i leave. He says that he could never hurt me but he is hurting me now. I wish to get an annullment or divorce. He is depending on me to go to an interview for him to get permanent residency in my country. I am afraid to go to the police because he said the most they could do is lock him up for a while and then he will get out. I have until Wednesday to make a decision. Please help.

Still waiting for GC
I got married and applied for Change of status in 2005 in MO. I still did not get my GC. It has been now three and half years. when it get approved will I get the conditional or the permanent residence. My wife and I are thinking to get legally separated but not divorced yet, does this change affect anything. Thanks

Help
Good Afternoon:

I saw your information on free advice website and just wanted to ask a quick question, that is, if you have the time to answer it.

I applied for my citizenship through naturalization. I got my greencard in 2004. In 2001, i got into some trouble, the case was dismissed and the conviction set aside, can this be used against me, even though i was not convicted. It was a felony charge of possession and transporting.

I went for my interview and they gave a me a list of documents that i need to submit. I have submitted everything, but they keep asking me for documents pertaining to this case. They asked for the disposition, which i sent, now they are asking for the statement of charges.

I heard that they can put me in removal proceedings. Is this true? Even though that incident happened before i got my greencard?

Petition For Alien Family Member
Hello. I'm a U.S. Citizen who has an immigrant husband. He came to the U.S. legally but he has overstayed his allotted time by about 6 years. We've been married close to a year and have a 9month old son. We live together also. I recently filed a Petition for an Alien Family Member in July of 2007 and I was wonder do you think that there's a strong possibility that they will deny him seeing that he's over stayed his allotted time by more than 5 years?
