Green card expired
My brother was in jail for 6 months and his green card is expired. But i can't renew his green card without him, i was going to wait when he came out of jail and go renew it. The day that he's out i came to pick him up and they told me the immigration going to pick him up. And i have to wait until he called us. I don't know what to do now. I hope that he wont be kicked out of U.S. Help please?

DUI dismissed as a tourist
On a visit to the US in 2005 I stupidly got myself arrested on a DUI. I blew under limit and Public Defender said he couldn't understand why the case had actually been brought to court at all. Anyway he got it dismissed for me. The thing is that now i'm hoping to marry my fiance(American. i'm Irish) later in the year. I will be moving over to the US. We have sent in the petition and its been processed. I'm now incredibly worried that my stupidity will mess everything up. I'm at a loss what to do!! Do i mention this arrest on the forms?

Withheld Adjudication
I had an arrest in 1999 for the sale of 5 grams of marijuana. My plea was no contests and I recieved 2 years probation with a withhold adjudication. I adhered to all the conditions of my probation and had my probation terminated after only one year. I have traveled outside the country twice since the arrest without any complication but am afraid to travel outside the country. I have even applied and recieved my concealed weapons licence since and also renewed and recieved my greean card. What are my options now?

You can file for a divorce in NY. You will need to serve your spouse in Jamaica either by getting him to sign the acknowledgment of service or by using a bailiff to serve him. As long as you can prove he is properly served with the divorce you will be able to obtain a judgment of divorce in NYC

You may get married in NJ. If the papers are filed in NY the Immigration officer assigned to your interview will require joint documentation supporting your marriage in NY. For example bank statements, joint tax returns bills, and credit cards in NY. It usually takes approximately 90 days after you file to receive your work authorization card and approximately 180 days for the green card interview to be scheduled.

What can I do?
I married an illegal alien for what was supposed to be for love. I paid for the attorney and all fees to get my spouse's immigration status changed to conditional resident. I paid for the wedding and I completely financially and emotionally supported my spouse for more than a year. My spouse was not working. After status was changed, I got my spouse a job. Prior to mirage, my spouse promised and agreed to pay for half of our wedding and living expenses when my spouse starts working. My spouse refuses to contribute to any of the wedding and living expenses accrued from the wedding onward and is now hardly contributing to our current expenses. What can I do? I am now broke because of this. I no longer wish to remain married to this person but can't afford a divorce. My spouse's conditional status will expire in June of 2008. What can I do about this?

my divorce is almost final...He told me he was a citizen, hes not. He has a greencard that expires in 2008..his behavior over the past years has landed him in jail for abuse, and he is in trouble with the IRS and is listed on the Employer Violations list of the Ins Commissioner of Wva...When his green card is up for review will he be denied based on his behavior? B2 Visa holder / Marring an American Citizen
I am an B2 Visa holder, when i met my Fiance here i was a J1 visa holder at the end of my program i came back to my Country and i decided to come back to the States with a Turist visa (B2) i got a 6 months permission at the port of entry. I have 3 week left before my permission ends.
The last week my Boyfriend proposed me, we love each other and want to be together, we know we can get marry here now that i am in a legal status but my boyfriend needs to travel for work and when he backs i ll be Out of Status and the we were planning to get marry.
We dont want to wait for a Fiancee visa because it takes to long and we want to be together.
Is os that we marry like a week after the time expire ?

My wife and I have drifted apart and she is now dating another man. She left me and is gloating that she will get half of our (which is my) earnings over the marriage if I divorce her.

I had a friend which she would like to ask you:

"I have a complex situation. I arrived to US on last year and received my green card with conditions. we lived for a few months (4) and then I left and moved to Texas and currently file for a divorce and it is still depending. there were no or any physical abused or any thing like that. It seemed we dont have any commons.
My question is - what are my chances of getting remove the conditions on my green card? If I married again after my divorce is completed - does that affect my green card status?
I know he wrote letters to USCIS indicating that I was using him to obtain legal status in US - while this divorce is still depending and my 2 years anniversary will be due in next summer.

Hi this is Leonardo and i'm from Italy, My parents used to live here for 8 years in the 70's and my mother became american in 1978. After that they went to live in italy and i was born there in 1983. Now we came back in America to live...I would like to know if is that possible that i cannot be american citizen from my mother that she is american citizen, and my brother was born here in united states. we live here now, but i have a b1/b2 visa and every 6 months i should go back to italy to renew my visa. this is not possible. i apply also for the petition n600, and they told, well you mother supposed to be here in united states at least 5 years after she get the citizenship, she shouldn't leave america right after she got the citizenship. SO what??????? I must stay in Italy like a dog? under a bridge? Or i should apply for the green card and i have to wait in italy without a house? It will take at lease 4 or 5 years this operation. Do back and forw from Italy is not good i think for my status... What should i do? This is rediculos!!! Please help me!

I met my current boyfriend 5yrs ago he is Jamaican and was over here on a tourist visa. Recently he went back and got into some trouble for trafficking to Curacao. The charges were dropped, but the usa cancelled his visa when he tried to come back saying that he would have to show proof that the charges were dropped. I Have the papers from curacao saying that they were dropped, so now we are going to try for a fiance visa do you think those charges will affect our chances of getting approved?

dying to know
i overstayed on my visa, my sister is a us citizen who is planning to file for me. i am aware that it may take 10 years before i get a green card ,is it going to take the same amount of time for a work permit. also she is currently filing for my mom ,should i just wait for my mom to get here and file for me. ps. i'm 23yrs old

divorce
My question is my husband visa was denied but he does not want to continue with the process because they didnt believe us that we are in love they told us he just to migrate to the united states we been married for 4 years when spoke to an attorney and she told us the best thing to do is to have a baby my husband does not want kids I told him to lets get a divorce how long do we have to wait before we file for divorce I dont want them to think I that our marriage was a fraud. Please help

I have been married for the past 3years now and I have went to see two different layers now however I come to find out that all I need is my i94 to process my document they have send two different place now to search for it and they could not find it how could i go about searching for it have you ever heard about uscis. It has been 12years now in this country. Thank you

You can file an application to replace the I-94 card. The process takes approximately 4 months for you to receive the replacement card.

You will need to apply for a waiver or a pardon from the Department of Homeland Security, The waiver application usually takes approximately 1 year for a decision. You will need to show that your new wife will suffer extreme hardship if the waiver is not granted

I live in Louisiana and have for two plus years, my wife and I are in the process of a divorce and she took my son to New Jersey before our custody hearing. My question is If the Louisiana courts give me custody will New Jersey honor the court order and help me get my son back??

I got a friend who stay over her visa. Shes been here from she is 18 years old. Her father is a citizen in the US an she is 21 years old now. My question is can she aply for her citizenship by her self?
